Within the Office of the Attorney General, the Division of Medi-Cal Fraud and Elder Abuse (DMFEA) works to investigate and prosecute fraud against the Medi-Cal program and abuse and neglect within California’s care facilities. Within DMFEA, the Facilities Enforcement Team plays a unique and critically important role in ensuring the safety and care of elderly and dependent persons residing in nursing homes and other facilities by prosecuting allegations involving systemic fraud, abuse, and neglect in criminal and/or civil state court actions. The Facilities Enforcement Team is a hybrid unit, utilizing both criminal and civil litigation options to accomplish DMFEA’s mission.
Typical duties of the Facilities Enforcement Team Deputy Attorney General include:
– Working collaboratively with a multi-disciplinary team of civil attorneys and criminal attorneys, special agents, nurses, auditors, and legal staff to investigate abuse and neglect referrals and complaints.
– Advising on the development of investigative plans, including reviewing warrants and interview strategy, and working with expert witnesses. – Evaluating evidence and potential theories of culpability for a filing decision.
– Prosecuting criminal elder abuse cases in state court at all stages of litigation, including charging, motion work, settlement or jury trial, and sentencing.
– Litigating civil actions, establishing civil liability of owners, operators, and controlling entities of adult care facilities, including corporate liability for unfair business practices under California Business and Professions Code section 17200.
– Assist with unannounced inspections of nursing home facilities as part of the Operation SAFE program.
– Participate in training and public/law enforcement outreach.
